The Okapi Wildlife Reserve (OWR) has been listed as a UNESCO World Heritage Site since 1996. It is located in the provinces of Ituri and Haut-Uele, in the north-east of the DRC. The OWR contains one of the country’s most important remaining forest elephant populations, the largest population of the eastern chimpanzee, and by far the largest population of the endemic Okapi.
WCS has been active in the OWR for more than 30 years, supporting its creation, and subsequently working closely with ICCN (Institut Congolaise pour la Conservation de la Nature) – the government agency responsible for protected areas and wildlife – in its management. In December 2018, WCS and ICCN signed a 10-year management agreement that delegated management authority of the OWR to WCS. This mandate is implemented through the OWR Management Unit (RMU), led by the Reserve Director, that is the executive body in charge of all day-to-day management activities and personnel in the OWR.
Under this Agreement, WCS is mandated to ensure the development of the Okapi Reserve Rules & Regulations to set certain rules for a smooth running of activities.
I. OBJECTIVE
The purpose of the consultancy is to produce for the OWR a document that governs all OWR employees in accordance with applicable laws in the DRC and the statutes of both partners.
II. CONTENTS OF THE Okapi Reserve Rules & Regulations
- The provisions in the Okapi Reserve Rules & Regulations (reglement interieur) shall be in accordance with the laws of the DRC, and WCS and ICCN’s regulations
The regulations of health and safety within the OWR
The general and permanent rules relating to discipline, specifying the nature and the level of sanctions that can be taken by the Management Unit of the OWR (UGRFO)
Essential elements to be developed in the document are:
- The general provisions of the Okapi Reserve Rules & Regulations
Standards of conduct
- Code of ethics
- Confidentiality
- Conflicts of interest
- Code of conduct
Process of hiring and transfer
Leave management
Advancement in grade / function
Performance Evaluation
Relations with UGRFO, ICCN and WCS
Health and Safety
Sanctions and disciplinary procedures, including the nature and scale of sanctions
Provisions relating to employee rights, particularly harassment (moral, sexual and others)
Provisions relating to the rights of employees (right to be informed in writing of the deficiencies of the agent, right to be summoned to an interview prior to sanction, right to be assisted during the interview)
Provisions for different bonuses and allowances granted to employees (depending on applicability)
Entry into force of the regulation within the OWR
III. METHODOLOGY
The Okapi Reserve Rules & Regulations must be based on the law, and the various documents relating to WCS and ICCN employee contracts.
Interviews with key officials of both Organizations to understand the system and operations of each entity will take place.
Validation of the Okapi Reserve Rules & Regulations by the Steering Committee of the OWR (CPRFO).
Validation of the Okapi Reserve Rules & Regulations by the Labor Inspector
IV. DELIVERABLES
The expected deliverable is the Okapi Reserve Rules & Regulations (reglement interieur) which will comply with the requirements of the law in the area of the labor code in the DRC and the statutes of the two partners. This is to be provided in French.
V. DURATION OF THE CONSULTANCY
The duration of the Consultancy will be up to 45 days including review of the draft by WCS and ICCN Managers.
VI. CONSULTANT PROFILE
Graduate Diploma in Law, or Social Sciences.
Have experience in the field of Human Resources management.
Have excellent writing and summarizing skills
Have experience working in DRC
Have experience in developing rules of procedure for an organization.
Fluency in French and English
Computer literacy
VII. CONSULTANT FOCAL POINT
The Director of Administration and Finance is the focal point and the Consultant will give a regular update of the work to the HR Manager of WCS DRC program, to the Director of the OWR, to the Administration and Finance Officer of the OWR and to the Regional Business Manager.
The Consultant will give a brief report periodically to the WCS DRC Country and to the WCS Central Africa Regional Director.
