1.    Background and Objectives of the assignment

The Consultant will serve as a WIPO Madrid System subject matter expert responsible for increasing Madrid System for the international registration of marks utilization among law firms and corporate users in the United States of America (USA).  The Consultant will leverage comprehensive business development and sales support provided by WIPO to engage with qualified prospects and convert them into active Madrid System users through expert consultation and relationship management.

2.    Deliverables/services

(a) Core Business Development Activities

Strategic User Engagement:

Prepare and execute a comprehensive marketing and business development approach designed to reach out and connect with current and potential users of the Madrid System in the USA.  The approach should include:

i. Establishing and nurturing relationships with key stakeholder groups:

•     Major IP law firms and trademark prosecution practices
•     Corporate IP departments and in-house counsel
•     High-potential filers and serial trademark applicants
•     Key influencers (IP associations, corporate counsel groups, bar associations, chambers of commerce, industry federations, etc.)

ii. Conducting high-value, targeted meetings and consultations individually or in small groups with agents/attorneys, law firms, corporate users, and influencers

iii. Engaging with qualified prospects identified through WIPO-led data analytics and prospecting activities

Expert Consultation and Technical Advisory:

i. Provide subject matter expertise on Madrid System legal framework, procedures, and strategic advantages
ii. Advise on complex filing scenarios, portfolio management, and international trademark strategy
iii. Address technical and legal questions from sophisticated US practitioners
iv. Demonstrate Madrid System tools (eMadrid), platforms, and operational workflows

Market Intelligence and Feedback:

i. Gather detailed market intelligence on US market needs, barriers to adoption, and competitive landscape
ii. Report user feedback, system improvement suggestions, and emerging market trends to WIPO
iii. Identify case study opportunities and document success stories

(b) Minimum Performance Requirements (Quarterly Basis)

The Contractor must achieve the following minimum thresholds each quarter:

i. User Engagement:

Minimum 60 meetings per quarter, comprising:
•     At least 15 meetings per month with high-potential law firms/corporate users/potential filers/representatives
•     At least 5 meetings per month with top-tier existing filers/representatives

ii. Conversion and Business Development:
•     Achieve measurable conversion of engaged prospects to active users
•     Track engagement-to-filing conversion rates
•     Document progression through sales pipeline stages

iii. Promotional Activities:
•     Lead or co-present at minimum 4 events per quarter (conferences, seminars, roundtables, webinars)
•     Participate in at least 1 WIPO Madrid System public webinars per quarter
•     Achieve participant satisfaction rating of ≥85%
•     Represent WIPO at major US IP conferences and trademark practitioner events

iv. Case Studies & Market Intelligence:
•     Identify and document minimum 2 US-specific success stories of Madrid System use by local businesses or law firms per quarter
•     Contribute to development of US-market-focused marketing and training materials
•     Provide input on messaging and positioning for US legal/business audiences

v. Knowledge Development & Partnerships:
•     Contribute to training materials development
•     Develop and maintain strategic relationships with key IP and industry associations
•     Major IP law firm partnerships and networks
•     Corporate IP counsel associations

(c) WIPO Business Development and Sales Support

WIPO will provide comprehensive backend support including:

Data Analytics and Prospect Identification:
•     Analysis of US trademark filing data to identify high-potential prospects
•     Segmentation of law firms and businesses by filing patterns and international exposure
•     Scoring and prioritization of leads 

Lead Generation and Outreach Support:
•     Initial outreach campaigns (email, digital marketing, targeted communications)
•     Qualification of prospects through preliminary screening
•     Scheduling support for consultant meetings (when possible)
•     CRM system management and lead tracking

Event Logistics and Coordination (when possible):
•     Event planning and logistics management
•     Marketing and promotional support for events
•     Registration management and participant communications
•     Materials preparation and distribution
•     Post-event follow-up coordination

User Engagement and Administrative Support:
•     Development of US-market marketing collateral
•     Webinar production and technical support
•     Reporting tools and templates
•     CRM and contact database maintenance
•     Performance tracking and analytics dashboards

(d) User Support and Liaison
Act as focal point for Madrid System users in the USA, responding to queries in liaison with WIPO Madrid Registry customer support.  Facilitate resolution of user problems and system navigation challenges.  Act as advocate for US user needs within WIPO.

(e) Additional Tasks
Perform other tasks as required by the Organization consistent with assignment objectives.
 

3.    Reporting

The Contractor shall work under the coordination of the Communications and Information Manager of the Madrid Information and Promotion Division, Madrid Registry.

4.    Profile

  • University degree in law, marketing, business administration or related field.  Active member of a US state bar preferred
  • Minimum three (3) years of relevant professional experience as a trademark practitioner in the USA, in an IP Office or comparable working environment.  Knowledge of USPTO trademark procedures and US trademark law
  • Deep expertise in Madrid System legal framework, procedures, and strategic applications
  • Good knowledge of the business and administrative procedures of WIPO, the Madrid System notably, and the examination of trademark applications at the national and international levels 
  • Knowledge of international IP protection strategies and portfolio management
  • Demonstrated track record in business development, client relationship management, or legal practice management
  • Ability to explain the rules, regulations and procedures governing the area of work clearly and persuasively to complex legal/procedural concepts
  • Integrity in dealing with confidential and sensitive data
  • Flexibility to travel extensively within US and manage independent schedule
  • Excellent command of English (written and spoken)

5.    Duration of contract and payment

The duration of the contract shall be from February 1 to July 31, 2026, and may be renewed based on performance, organizational needs, and budget availability, up to a maximum cumulative duration of 24 months at a 100% activity rate.

Work Arrangement: This assignment may be structured on either a full-time or part-time basis depending on mutual agreement between WIPO and the selected candidate.  The activity rate (percentage of full-time equivalent) will be specified in the contract and will determine the monthly base honorarium calculation.

Applicants are requested to provide an indication of their remuneration expectations as a daily rate in Swiss francs (CHF), or US Dollars (USD), exclusive of any performance bonus. Please also indicate your availability and preference for full-time or part-time engagement.

Compensation Structure:

•     Base Honorarium: Determined based on the candidate’s qualifications and relevant professional experience.
•     Performance Bonus: The Consultant may be eligible for a performance-based bonus calculated at a fixed rate of CHF 75 per eligible international trademark application filed above the established baseline.

Performance Bonus Calculation and Conditions:

•     The baseline shall be defined as the five-year historical average of international trademark applications filed by the companies or law firms actively engaged or visited by the Consultant during the contract period.
•     Only applications exceeding the established baseline will be considered eligible for bonus calculation.
•     Eligibility is limited to applications filed by companies or law firms that were actively engaged or advised by the Consultant during the contract period.

Maximum monthly bonus: Up to 20% of the base honorarium.

Total maximum monthly earnings: Base honorarium plus maximum 20% performance bonus.

Performance Review:

Monthly and quarterly assessment of KPI achievement, including.

  • Number of meetings and consultations with high-potential law firms, corporate users, and prospects.
  • Conversion of engaged prospects into active Madrid System users.
  • Participation in events, webinars, and promotional activities.
  • Submission and quality of market intelligence reports, case studies, and feedback.

Ongoing calculation of bonus eligibility throughout the contract period.

Regular or consistent failure to meet minimum requirements may be considered a breach of contract, potentially entitling WIPO to terminate the contract.

Travel Arrangements

The Contractor is responsible for organizing their own travel arrangements for any missions directed or authorized by WIPO from the place of assignment, and handle all the related purchases and payments themselves.
WIPO will reimburse travel expenses up to a maximum amount for the contract period, with payments only being made against receipts/presentation of tickets.

6.    Non-disclosure of confidential information

In the course of their official duties, the Contractor may have access to confidential information, including information related to applications for intellectual property protection, business strategies of companies and law firms, and WIPO internal data and analytics.

The Contractor undertakes to not disclose or use any confidential information for personal gain or for any purpose other than the performance of their official duties.  They also have a duty to report any conflict of interest should one arise.

7.    Other Information

ICS Consultants fall outside the coverage of employment contracts for WIPO Staff members and are not subject to the WIPO Staff Regulations and Rules. The Consultant has no entitlement to vacation or sick leave, except for WIPO official holidays, or to medical insurance or staff pension. Absences from work will be deducted from the Consultant’s payment on a pro-rated basis.
