    Organizational Setting and Work Relationships

    The position of Senior Legal Officer – Institutional Matters is located in the Legal Affairs Service (LAS) in Headquarters under the general supervision of the Head, Legal Affairs Service. The Senior Legal Officer -Institutional Matters will provide expert legal advice on a broad range of matters within the scope of the work of LAS. This will include advice on questions of a public international law nature, for example on matters of privileges and immunities; UNHCR¿s engagement with international accountability mechanisms; and issues related to sanctions. The incumbent will also advise on key institutional matters, in particular those relevant to the institutionalisation of cash based interventions (CBI) in UNHCR. In addition, part of the responsibility of the incumbent is to act as LAS focal point on work related to the prevention of sexual exploitation and abuse and sexual harassment (SEA/SH) activities, engaging with the Senior Coordinator and other internal and external actors on a daily basis.

    The incumbent will function on a largely autonomous basis and may supervise interns, consultants and junior staff members. The incumbent will be required to work with a wide array of clients, including with various UNHCR HQ and Field based colleagues, with particularly close relationships with colleagues in Treasury, Global Cash Operations, and with the SEA and SH Unit in the Division of Human Resources.

    All UNHCR staff members are accountable to perform their duties as reflected in their job description. They do so within their delegated authorities, in line with the regulatory framework of UNHCR which includes the UN Charter, UN Staff Regulations and Rules, UNHCR Policies and Administrative Instructions as well as relevant accountability frameworks. In addition, staff members are required to discharge their responsibilities in a manner consistent with the core, functional, cross-functional and managerial competencies and UNHCR¿s core values of professionalism, integrity and respect for diversity.

    Duties

    The position of Senior Legal Officer – Institutional Matters is a demanding position that requires discretion and confidentiality. The incumbent is expected to expedite requests and queries on short notice while maintaining the legal quality and operational relevance of the advice.

    The Senior Legal Officer – Institutional Matters will provide advice on a range of legal issues that fall within the competence of the Legal Affairs Service (LAS). These include, but are not limited to, questions of a public international law nature, including on privileges and immunities; UNHCR¿s engagement with international accountability mechanisms; and issues related to the application of sanctions. In addition, the Senior Legal Officer will:

    • Provide legal advice on UNHCR¿s institutional engagement with other international organisations, including in the drafting and negotiation of appropriate legal agreements and frameworks.
    • Provide advice on UNHCR¿s institutional engagement with external policy and standard setting bodies in fields relevant to UNHCR¿s work.
    • Provide legal advice on diverse substantive and procedural questions of considerable complexity, which may include those related to administration and management, procurement and contracts and other operational matters.
    • Provide legal advice on the application and interpretation of UN Regulations and Rules, Administrative Instructions and relevant policies.
    • Provide legal advice on dispute resolution including arbitration or litigation; assists in establishing case strategy; assists in drafting the legal position and appropriate pleadings and documents.
    • Liaise with the UN Office of Legal Affairs in New York, and with legal offices in UN agencies on any relevant issues.
    • On behalf of UNHCR liaise, correspond and negotiate with relevant third parties on the legal aspects of the conclusion, interpretation and/or implementation of contracts and agreements.
    • Review, advise and draft complex contracts, agreements, institutional and operational modalities, or other legal documents; develop new legal modalities to meet unique needs/circumstances.
    • Provide legal advice on diverse substantive and procedural questions of considerable complexity, including on issues relating to UNHCR¿s engagement with the private sector, taking into account the Consolidated Refugee Response Framework and Global Compact on Refugees.
    • Perform any other responsibilities/functions deemed necessary or as delegated by the Head of Service.
    • In coordination with, and as delegated by, the Head, Legal Affairs Service, represent LAS in meetings within UNHCR and represent UNHCR with external counterparts.

    In relation to the institutionalisation of cash based interventions in UNHCR, the Senior Legal Officer -Institutional Matters will, in a multi-disciplinary context:

    • Draft, negotiate, review and provide legal advice on the conclusion, interpretation and legal implications of contracts and other agreements and related processes related to CBI.
    • Advise on institutional objectives for UNHCR related to CBI, including on data protection, financial inclusion, the use of digital identity, and related issues.

    As LAS focal point on issues related to Sexual Exploitation and Abuse and Sexual Harassment (SEA/SH), the incumbent will provide legal advice on institutional matters related to UNHCR¿s response to sexual exploitation and abuse and sexual harassment, including:

    • Representing the Legal Affairs Service at the working group chaired by the Senior Coordinator on SEA and SH and other relevant bodies as appropriate.
    • Contributing to review and design of new, or new applications of, legal instruments, policy, and guidelines.
    • Legal review of internal and external documents.

    Perform other related duties as required.

    Minimum Qualifications

    Years of Experience / Degree Level
    For P4 – 9 years relevant experience with Undergraduate degree; or 8 years relevant experience with Graduate degree; or 7 years relevant experience with Doctorate degree

    Relevant Job Experience
    Essential:
    Bar exam or equivalent qualification to practice law in at least one national jurisdiction. In-depth knowledge and experience of international law preferably, including the law and practice of the United Nations. Good knowledge and experience in addressing, preventing and/or responding to sexual harassment and sexual exploitation and abuse, preferably within the United Nations context. Expertise related to the status, privileges and immunities of the United Nations or other international organizations. Strong analytical skills and ability to conduct legal research on a range of complex and intricate issues. Experience in drafting and negotiating a broad range of documents of a legal nature, including complex contractual frameworks of a commercial or financial nature, legal opinions, pleadings, and briefing notes. Demonstrated ability to provide oral briefings on complex legal issues to legal and non-legal audiences.
    Desirable:
    Thorough understanding of the UN system and of UNHCR¿s mandate and its operational structure. Knowledge of UN/HCR field operational realities. Knowledge of UN/HCR organizational regulatory frameworks and policies. Proven ability to deal with multiple tasks in a courteous and service-oriented manner in a demanding working environment with often short deadlines.
