  • UNDP Nepal is working with the Ministry of Law, Justice and Parliamentary Affairs (MOLJPA), Office of the Attorney General (OAG), Nepal Bar Association (NBA), other justice sector actors, and civil society organizations to implement the Enhancing Access to Justice through Institutional Reform Project (A2J Project). The A2J Project has four (4) major outputs focused on enhancing the access to justice at the local level, working on reform of the legal aid system, supporting national efforts of reform and coordination in the justice sector, implementation of constitutional provisions on fundamental rights through legislative reform, and contributing to implementation of the newly adopted criminal and civil legislations.

    To enable women and vulnerable groups to access justice, the A2J Project supports MoLPJA to lead reforms in the legal aid system in Nepal towards the implementation of the Integrated Legal Aid System which aims to coordinate and regulate accessible socio-legal aid service provision throughout Nepal. The A2J Project works to enhance capacity of Judicial Committees established at the Local Level as an effective mechanism of justice delivery for local community, with the aim to promote the access to justice of women, poor and vulnerable and to facilitate their easier access to justice and approach to legal remedies.

    The A2J Project is engaged in the reform of the criminal and civil justice systems by providing necessary support for the execution of the Costed Action Plan for the implementation of the newly adopted codes. Developing guidelines on implementation of codes and providing specialized trainings to judges, prosecutors, police officers, lawyers and other justice sector officials is a focus of the Project. The A2J Project works with justice sector actors with a view to enhance their capacity to address issues that may arise in the course of federalization which itself is a new area requiring specialized knowledge and skills at different levels.

    The A2J Project has a strong Gender Equality and Social Inclusion approach and provides professional opportunities to women and vulnerable categories of people through its scholarship and internship programs. Linkage of these programs and support to Judicial Committees and Leal Aid system is established to institutionalize the pro-bono culture in delivery of legal services in Nepal.

    Finally, the A2J Project explores opportunities to support effective delivery of justice for inclusive economic development through tailored trainings to the concerned stakeholders on conciliation / arbitration / mediation on complex commercial and foreign investment-related disputes. The A2J Project also works on issues of Business and Human Rights through advocacy efforts on inclusion of United Nations Guiding Principles on Business and Human Rights (UNGP), 2011 in the national legal and regulatory framework.

    The Access to Justice Specialist (A2J Specialist) will be responsible for supporting the overall implementation of Project outputs. S/he is entrusted with providing policy advice and strategic technical guidance for supporting legal aid reform, capacity development of Judicial Committees, legislative reform and alignment with international standards for responsible business conduct and for the overall oversight for the smooth and effective implementation of the project outputs . The A2J Specialist also supports coordination and liaison for the justice sector, donor coordination and resource mobilization. Furthermore, he/she will be required to create synergies and establish and/further develop knowledge networks in the practice area.

    In supporting the execution of relevant activities, the A2J Specialist will ensure that, by the end of her/his assignment, the MoLJPA as the lead agency and other implementing partners are better equipped to ensure access to justice for all in Nepal.

    Summary of key functions:

    Under the overall guidance and in coordination with UNDP Country Office (CO) and the implementing partners, the A2J Specialist will provide technical support to implement the Project activities and ensure that the Project objectives are met as set out in the Project document. Administratively, the Access to justice Specialist will report to the Deputy Resident Representative and programmatically to the National Project Director (NPD) of the A2J Project and work in close collaboration with the Governance Portfolio Manager and the National Project Manager (NPM) for A2J Project. More specifically the A2J Specialist will:   

    • Provide strategic guidance and advisory support to the NPD and NPM on access to justice and legal aid issues;
    • Coordinate timely delivery of high-quality project activities and reporting and support UNDP management in programme development and resource mobilization;
    • Support the establishment, monitoring and evaluation system for legal aid service provision and support the Central Legal Aid Committee (CLAC) and its’ Secretariat in the implementation of its action plans;
    • Support partnership building, synergies and knowledge sharing;
    • Support the development and implementation of training programs on legislative drafting, and the development of systems and procedures for the revision of laws.
    • Ensure strengthening Gender Equality and Social Inclusion (GESI) and Human Rights Based Approach (HRBA) throughout A2J Project interventions;
    • Provide high quality technical support to law faculties to develop and implement an ‘affirmative action’ legal education, including establishment of scholarship, internship and professional development scheme, and clinical legal education;
    • Perform any other tasks as assigned by the NPD, NPM and UNDP Management.

    Functions/ Expected Results:

    1. Provide strategic guidance and advisory support to the UNDP, NPD and NPM on access to justice and legal aid issues

    • Provide advice to NPD, NPM, A2J Project staff and implementing partners to plan the activities of the A2J Project related to access to justice and legal aid issues;
    • Support NPM and A2J Project staff in preparation of project work plans and budgets;
    • Support NPM in the preparation of TOR for relevant consultants and sub-contractors;
    • Prepare aide memoires, conference agenda’s and other strategic tools to guide project activities;  
    • Liaise with respective partners in UNDP Country Offices, Regional Center and cooperating organizations to manage the political risk of strategic interventions and ensure smooth A2J Project implementation;
    • Facilitate policy development, knowledge management and coordination in rule of law, access to justice and legal empowerment.

    2. Coordinate timely delivery of high quality A2J Project activities and reporting and support UNDP management in programme development and resource mobilization

    • Support NPM and Output Leaders in the day to day implementation of the A2J Project activities;
    • Support the Project Management Unit for the effective implementation of the project activities;
    • Share knowledge through inputs to comparative experiences and lessons learnt on regional and global levels and participation in relevant fora;
    • Advise the NPM and Output Leaders on the overall implementation of the A2J Project, including quality planning and reporting on progress vis-à-vis planned activities and expected outputs, and making specific recommendations as required;
    • Ensure effective A2J Project implementation, financial management, coordination and administration, using established guidelines and procedures of UNDP and the Government of Nepal to realize maximum performance and impact; and
    • Oversee the effective development and implementation of the A2J Project monitoring and evaluation system, and report on progress, including reporting to UNDP, development partners, and national stakeholders on progress;  
    • Support in preparing progress reports for the development partners and UNDP;
    • Support UNDP in formulating/designing new programme in this area of intervention and work for resource mobilization.

    3. Support the establishment, monitoring and evaluation system for legal aid service provision and support the CLAC and its’ Secretariat in the implementation of its action plans

    • Support the MoLJPA in revising the legislative and regulatory framework pertaining to legal aid;
    • Support the MoLJPA to develop and maintain reporting, monitoring and evaluation system for legal aid service providers;
    • Support implementation of legal aid outreach activities;
    • Provide necessary technical assistance to CLAC for establishment of its’ Secretariat, including drafting of operational guidelines;
    • Support the CLAC in the implementation of its action plan.

    4. Support partnership building, synergies and knowledge sharing

    • Liaise regularly and forge close linkages with other A2J Projects, agencies and entities, as well as other international and national stakeholders concerned with or providing assistance on access to justice and rule of law issues in Nepal to maximize synergies and avoid duplications;
    • Contribute to the harnessing of effective partnerships and competitive selection of partners for the implementation of UNDP projects;
    • Build partnerships with access to justice sector agencies via coordination mechanisms such as case-management committees and case-management reforms;
    • Liaise with and maintain regular contact with legal aid mechanisms, line ministries, Nepal Bar Association, UN agencies, national human rights institutions, CSOs and donors, and support ongoing coordination efforts;
    • Develop pilot initiatives for functional partnership between justice sector stakeholders and non-governmental organizations, local media and public;
    • Explore possibilities and actively promote synergy with UNDP CO portfolio and various projects;
    • Support knowledge sharing with national counterparts through on – the job training, knowledge sharing workshops and publications.

    5. Support the development and implementation of training programs on legislative drafting, and the development of systems and procedures for the revision of laws

    • Provide necessary technical guidance and support in developing systems and procedures for revision of the laws related to access to justice in line with new Constitution and international human rights standards;
    • Support the development of training A2J Projects on legislative drafting including identifying and leading the working group of national experts that will be trained for this purpose;
    • Support MOLJ to amend the Legal Aid Act in line with the Constitution and recognized international human rights standards;
    • Ensure and organize timely preparation and completion of technical reports.

    6. Ensure strengthening Gender Equality and Social Inclusion (GESI) and Human Rights Based Approach (HRBA) throughout A2J Project interventions

    • Provide necessary technical assistance and direction on strategic and policy issues to strengthen GESI and HRBA initiatives in the A2J Project plan and implementation strategy;
    • Advise NPM and Output Leaders to ensure proper coordination among justice sector, legal aid and human rights for better results on GESI;
    • Facilitate creation of enabling environment with government/other stakeholders for developing legal/ policy frameworks to prevent/address violence and services in place to address violence;   
    • Ensure GESI and HRBA issues are substantially incorporated in policy notes and briefs of government and UNDP; Support NPM and Output Leaders to ensure that management of A2J Projects is conducted with GESI and HRBA considerations;  
    • Work with other teams and units to ensure that management of A2J Projects is conducted with GESI and HRBA considerations;
    • Liaise with CO Gender Specialist as per the need for effective implementation of the GESI strategy and other guiding tools.

    7. Provide technical support to law faculties to develop and implement an ‘affirmative action’ legal education, including establishment of scholarship, internship and professional development scheme, and clinical legal education

    • Provide technical support to law faculties in developing rules and procedures for ensuring easier access of disadvantaged groups to legal studies;
    • Support the law faculties in developing criteria’s and procedures for allocation of scholarships to students from disadvantaged groups;
    • Provide technical support to law faculties in designing clinical legal education programs and support in devising innovative internship and professional development schemes;
    • Provide technical support to law faculties in devising courses and training programs related to issues of Access to Justice, human rights and social inclusion.

    Education:

    • Completion of Advanced Master’s degree preferably in Law, Human Rights, International Studies, Social Sciences or a related field.

    Experience:

    • Specialized knowledge in the areas of rule of law, judicial reform and on access to justice including in-depth familiarity with the international legal and policy framework and comparative international models and ‘best practices;
    • 7 years of experience are required in the field of rule and law, access to justice, justice sector coordination, legislative and judicial reform and human rights;
    • Previous work experience in South Asia and/or Nepal and working on issues related to transition will be considered an asset;
    • Previous experience with the United Nations System, including UNDP is desirable;
    • Working experience in the post conflict scenario will be preferable.

    Language Requirements:

    • Demonstrated excellent command of spoken and written English.
